Tenant InsolvenciesTENANT INSOLVENCIES: A LANDLORD'S OPTIONSFollowing on from our article about what landlords can do when their tenants are in financial difficulties, which focussed on trying to negotiate with the tenant with a view to avoiding the tenant going into insolvency and thereby maintaining some kind of rental stream (albeit reduced or payable monthly), this article deals with the situation where the tenant is actually insolvent. Unfortunately in many cases the landlord will receive no notice of the fact that the tenant has entered into an insolvency process and can therefore only react once it is informed.The rights and remedies of the landlord where the tenant is insolvent will depend on what sort of insolvency event is occurring - bankruptcy (for an individual), receivership, administration, liquidation or voluntary arrangements.
