Delivering the compensation you deserve.
tripping & slipping accident claims
Local councils and businesses have a legal duty to follow health and safety laws designed to keep you safe, this means they have a duty to carry out risk assessments making sure wet floors are clearly marked, fixing faulty paving slabs and pavements within a reasonable timeframe. So, if you are a visitor or customer on someone else’s premises and suffer an injury after a slipping accident which you do not believe was your own fault then you may be entitled to make a personal injury claim against the owner or occupier.
For example, supermarkets can be hazardous, as drinks or other products can be easily spilt – it is therefore important for these premises to have regular shop floor inspections, to prevent the risk of injury. You may be able to make a claim for compensation against them if the owner or occupier did not:
- Have an appropriate system for checking floor spillages.
- Clean up the spillage effectively when discovered.
- Have any warnings about a slippery floor.
You should also be provided with a safe place of work by your employers, so if you suffer a slipping injury because this responsibility is not met, then you may also have a claim against your employer. See also our section on accidents at work.
Tripping Accidents
If you have been injured through a trip or fall, we can help you to find out if you are able to make a claim for compensation.
What should I do?
Like many accidents we recommend you contact us right away, but it is also important that you gather as much evidence as possible. It is important to take accurate measurements of the defects as soon as possible, as repairs are often carried out very quickly afterwards. Photographs of the wider area are also essential, as the courts have been known to consider the general condition of the surrounding area.
At Geoffrey Leaver Solicitors our experienced Personal Injury team has a wide range of experience with slipping and tripping accident claims, which has resulted in winning thousands of pounds in compensation for clients.
In this recent case our team was able to achieve £17,000 in compensation after the client tripped over a broken paving slab, to learn more about this case: Client wins over £17,000 in compensation after tripping over a broken paving slab
Local councils have responsibilities to ensure any pavements and pathways are well maintained and safe for use by the public and are responsible for:
- Gritting roads and pavements in snowy or icy conditions.
- Fixing potholes or cracks in the road, especially if they have the potential to cause a serious accident.
- Maintain public playgrounds.
- Ensuring there is sufficient lighting on walkways.
- Ensuring there is adequate signage near roadworks.
How much are slipping & tripping accident claims worth?
Every claim is different, but there are guidelines which the courts use as a starting point. Our team will ensure that your claim considers lost earnings, care, private medical treatment, out of pocket expenses and any other justifiable expenses as a result of the injury.
Is there a time limit for a Personal Injury claim?
All personal injury claims need to be filed within 3 years from the date of the accident, very often we have clients who contact us past the deadline of 3 years and we are unable to help, so do not delay in making your claim.
Can I make a No Win No Fee claim for compensation?
The majority of claims we handle are arranged on a No Win No Fee basis, which means that you do not need to worry about expensive legal costs or pay anything upfront.
No win, no fee is where we take out an insurance policy on your behalf, meaning if your claim is unsuccessful you will not have to pay a penny. To learn more about how this works view No Win No fee.
Support & Rehabilitation
We know that if you have suffered a life-changing injury sometimes rehabilitation can take months or even years, which is why our focus doesn’t just end at delivering the compensation you deserve but continues to help secure the finances you need to pay for equipment and support with other care such as therapies/physiotherapy that are vital to helping your recovery. What’s more we will take the reins and give you peace of mind that the practicalities are being looked after such as organising medical assessments or assigning a case manager depending on your needs.
