Delivering the compensation you deserve.
child injury claims
Accidents happen all the time but when an accident involves a child it can be an emotional and distressing time for both the child and the parents. If your child has been unfortunate to suffer an injury which was the fault of someone else then you may be entitled to claim for compensation.
We have acted for many families where a child has been injured as a result of:
• a road traffic accident;
• a cycling accident;
• medical negligence;
• public places (shopping centres, parks, supermarket).
Who can make a child injury claim?
Children under the age of 18 are unable to pursue a claim themselves, however, a responsible adult which is often a parent or guardian can make a claim on their behalf. This person is known as a ‘litigation friend’ and their role is to take on all responsibilities related to the claim.
Is there a time limit for making a child injury claim?
Unlike an adult personal injury claim that needs to be filed within 3 years from the date of the accident, the child’s claim does not have a time limit until they reach the age of 18. This means a child injury claim for an individual under 18 can be filed any time before their 21st birthday.
How much compensation can you expect from a child injury claim?
A child’s injury can have a huge impact on the lives of every member of the family and the amount of compensation is dependent on a number of factors:
- Seriousness of the injury.
- Impact of the injury on your child’s life.
- The additional support and treatment the child needs in the future.
- The loss of earnings the parent has lost by way of income to stay at home to care for the child.
The total compensation comprises of three parts which includes the medical and legal expenses, the compensation for pain and suffering and for the future losses and expenses for ongoing medical treatment.
We have helped many families pursue serious head and brain injury claims, and by working with top medical experts and multi-disciplinary rehabilitation teams we are able to deliver the best possible outcomes for our clients.
Can I make a No Win No Fee claim for compensation?
The majority of claims we handle are arranged on a No Win No Fee basis, which means that you don’t need to worry about expensive legal costs or pay anything upfront.
No win no fee is where we take out an insurance policy on your behalf, meaning if your claim is unsuccessful you won’t have to pay a penny. To learn more about how this works view No Win No fee.
Support & Rehabilitation
We know that if you have suffered a life-changing injury sometimes rehabilitation can take months or even years, which is why our focus doesn’t just end at delivering the compensation you deserve but continues to help secure the finances you need to pay for equipment and support with other care such as therapies/physiotherapy that are vital to helping your recovery. What’s more we will take the reins and give you peace of mind that the practicalities are being looked after such as organising medical assessments or assigning a case manager depending on your needs.
