Injunction to prevent distribution of defamatory information
Geoffrey Leaver Solicitors successfully applied for an injunction to prevent the publication and distribution of defamatory information online, as well as personal harassment helping a client settle a traumatic personal vendetta being waged against him by a former franchisee. The case was eventually settled on confidential terms.
Professional Negligence on behalf of a minority shareholder
We have acted in a professional negligence claim in the High Court which has been brought on behalf of the minority shareholders in a livestock business.
The firm is taking legal action against the chairman and agent of the company for negligence and breach of fiduciary duties after the alleged sale of land at an undervalued price.
The value of the claim is potentially over £3m.
Breach of fiduciary duty and professional negligence
We recovered a substantial sum of money for two individuals who made a loan to a builder without being told by the solicitor who was acting for them at the time that the money was to be used to pay back a previous loan owed by the builder to that solicitor and other clients of his firm. When the builder was made bankrupt we claimed that the solicitor had acted in breach of his fiduciary duty and an accountant, who was in communication with the solicitor regarding the loan, was negligent by failing to carry out appropriate due diligence. The claim was settled at mediation.
Adjudication proceedings
We acted for a sub-contractor in adjudication proceedings regarding the valuation of the final account, which resulted in the main contractor being found liable to pay an additional £140,000 over that which it had previously valued the works as being.
Defended sub-contractor
A main contractor commenced adjudication proceedings against a brickwork sub-contractor claiming £140,000 for liquidated damages and contra charges. We represented the sub-contractor and we were able to significantly reduce the eventual liability to only £14,000.
