Product liability claims
Anyone who suffers injury as a result of a faulty or defective product, which has a substandard level of safety, should be able to make a Product Liability claim against the manufacturer under the Consumer Protection legislation. Typical situations include the following – and any of these situations this would clearly give rise to an action for compensation:
- The product had a design flaw such as dangerous edges or components, which could have been removed through proper design
- The product has ineffective or non-existent warning labels or instructions
- A dangerous object, such as a piece of metal, is found in pre-packaged food – which leads to an injury
- A child chokes on a loose component within a toy
It’s also worth knowing that, if you suffered an injury from a defective product as a child, then you can pursue the claim up to three years after your 18th birthday, irrespective of when the accident occurred.
