The Law Society has published a practice note that is intended to be used where one or more parties to a commercial contract want to execute that contract using an electronic signature. The note sets out whether the signature will be binding under our own law.
The types of contracts considered include simple contracts, deeds and documents subject to a statutory requirement to be in writing, signed or under hand. The note also deals with:
- The evidential weight of an electronic signature.
- Other legal and practical considerations to take into account when deciding whether to use an electronic signature.
The note represents the Law Society’s view of good practice and is not legal advice.
