What is a faulty product?

A faulty product is one whose level of safety is substandard.

1.     A product with a design flaw: The product may have dangerous edges or components. Were there any effective warning labels or instructions? Could the hazard have been removed through proper design?

2.     Pre-packed food: A dangerous object, such as a piece of metal, can inadvertently make its way into the packaging process. If this was to result in an injury, such as a consumer cutting their tongue or their finger on it, then this would clearly give rise to an action for compensation.

Who can claim?

Anyone who suffers injury as a result of a defect in a product should be able to make a claim against the manufacturer under the Consumer Protection legislation. It is worthwhile pointing out that manufacturers cannot escape liability by placing a term in the contract or by notice and any other provision.

Special circumstances for Children

Has your child suffered an injury from a defective product? For example, as a result of choking on a toy component? If so, it is worth remembering that the child can pursue the claim up to 3 years after their 18th birthday, irrespective of when the accident occurred.
