When someone is leaving your business you need quick and concise advice about the likely impact on your business. Likewise, if you’re trying to leave and your employer is being unreasonable you need to know where you stand.

Restrictive covenants in employment and service contracts are used primarily to protect the employer’s confidential information and customer relationships once the employee leaves their employment. This can often be a contentious area, and we advise and represent employers and employees in claims should there need to be a parting of the ways.

We understand that the threat of losing confidential information or clients can be extremely worrying and requires immediate and decisive action to protect businesses. This includes:

• restricting the employees access to information whilst they work any period of notice;
• the right to place an individual on garden leave;
• the immediate removal of an employee to protect confidential and sensitve information;
• lawful searches of computer equipment;
• obtaining injunctive relief to prevent breach of restrictive covenants and/or soliciting clients and staff.

We also regularly advise businesses that operate employee incentive or benefits schemes under which employees have received payments from a business towards further education, courses and such like which are repayable in specified circumstances such as termination of an employment contract within a defined period of receiving the benefit.
