Arbitration is where the parties have agreed, usually in their contract, to refer any disputes to an individual or a professional body who will appoint an individual to decide on the issues that are in dispute.
The actual process is similar to litigation: each party files a document setting out their case and the parties will be asked to disclose relevant documents, prepare and exchange witness statements and where necessary engage experts.
Some of the main differences between arbitration from litigation are:
- it is a confidential process whereas the judgment of a court may be published
- the parties can agree on the powers to confer upon an arbitrator and the procedures he is to follow.
- arbitration can be more flexible, with the dates and venue of hearing being dependent upon the parties and not the Court system.
